AI Additional Terms

These AI Additional Terms ("AI Terms") supplement and are incorporated into the Happycapy Terms of Service (the "Agreement"). These AI Terms apply specifically to your use of Happycapy AI features and services. Capitalized terms not defined in these AI Terms have the meanings given in the Agreement.

1. Scope and Definitions

"Happycapy AI" refers to all features and services provided by Happycapy that utilize artificial intelligence, machine learning, large language models, or other AI technologies. This includes but is not limited to:

• Content generation and creation tools
• Content editing and enhancement features
• Information extraction and summarization
• Translation and language processing
• Visual skill generation and manipulation
• Code generation and assistance
• Any other AI-powered features available through the Happycapy platform

"Input" means any data, content, prompts, instructions, or information you provide to Happycapy AI.

"Output" means any content, results, or responses generated by Happycapy AI based on your Input.

2. Data Usage and Privacy

Your access to or use of Happycapy AI does not grant Happycapy any right or license to use or share your Customer Data (including Inputs and Outputs) in a manner that is inconsistent with our Privacy Policy and the Agreement, unless otherwise explicitly agreed to by you in writing.

We do not use your Inputs or Outputs to train or improve third-party AI models without your explicit consent. However, we may use aggregated, anonymized data for service improvement purposes as described in our Privacy Policy.

Please review our Privacy Policy for detailed information about how we collect, use, and protect your data when using Happycapy AI.

3. Input and Output Responsibility

3.1 Your Responsibility

You are solely responsible for:

• Ensuring that your Inputs comply with all applicable laws, regulations, and policies
• Ensuring that your Inputs do not violate any third-party rights
• Reviewing, verifying, and validating all Outputs before using them
• Ensuring that your use of Outputs complies with all applicable laws
• Determining the appropriateness of Outputs for your intended use

3.2 Prohibited Inputs

You must not provide the following types of information as Input to Happycapy AI:

• Protected Health Information (PHI): Any information covered by HIPAA
• Government-Issued Identification: Social Security numbers, passport numbers, etc.
• Financial Information: Credit card numbers, bank account numbers
• Sensitive Personal Data: Information about children under 13, biometric data
• Confidential Information: Trade secrets, classified information
• Illegal Content: Content that promotes illegal activities

3.3 Output Characteristics

You acknowledge that:

• Outputs may not be unique
• Outputs may contain errors or inaccuracies
• Outputs should not be relied upon for critical decisions without verification
• Outputs may reflect biases present in training data

4. Use Restrictions

You specifically agree not to:

• Use Happycapy AI to develop competing AI models
• Misrepresent AI-generated content as human-created
• Generate spam or misleading content
• Reverse engineer the AI models
• Circumvent usage limits
• Generate harmful content

5. Third-Party AI Provider Compliance

Happycapy AI may utilize third-party AI services including Anthropic and OpenAI. Your use requires compliance with their acceptable use policies.

6. Disclaimers and Limitations

6.1 No Accuracy Warranty

HAPPYCAPY MAKES NO WARRANTY AS TO THE ACCURACY OR RELIABILITY OF ANY OUTPUTS. Outputs are provided "AS IS" and may contain errors, outdated information, or biased content. You must independently verify all Outputs.

6.2 Limited Liability

Happycapy's aggregate liability for all claims related to Happycapy AI shall not exceed one hundred dollars ($100.00).

7. Intellectual Property

7.1 Ownership of Outputs

Subject to compliance with these Terms, Happycapy assigns to you all rights in Outputs. However, Outputs may be similar to content generated for other users, and Happycapy cannot guarantee uniqueness.
